ROB MCKINNEY: My name is Rob McKinney. And if you're watching this video clip, either you or a loved one have been arrested for DUI.
I started out as a law clerk for the court in Nashville that heard all the DUI cases. I sat there for two years while I was working my way through law school and I heard vehicular homicide cases and numerous trials. Once I saw that, I wanted to dedicate my practice to helping people that's been charged with a crime.
The first area of a DUI case goes to the traffic stop. So the first main defense is did the police have a legal reason to stop your car? There's a host of areas that we can delve into and fight that.
Once the police officer stops you, the next thing that he'll want you to do is do a series of field sobriety tests. They are the horizontal gaze nystagmus test, the walk and turn and the one-leg stand.
These tests are subject and those results and the way they score the tests need to be reviewed by a competent attorney and an expert. That's why I went and got a certification as an instructor in field sobriety testing by NHTSA, which is the National Highway Traffic and Safety Administration. I know every nook and cranny of the manual and I know every way that we could look for imperfections in how that police officer did the field sobriety test.
The third main component of your DUI case is the chemical testing. The chemical testing for blood alcohol is usually done by two methods, breath and blood. In Nashville, breath testing is utilized. The machine is the ECR2.
One of the main defenses is whether the police officer watched you 20 minutes prior to giving the test. The reason is mouth alcohol and whether you burp, hiccup or belch during the test. Because alcohol can come from your stomach and contaminate the test. That's the most critical one. Because if the 20 minute observation period isn't given then that breath test is inadmissible.
Blood tests are more problematic. Was the blood sample drawn properly? Was it preserved properly? Was the tube maintained properly? Was the chain of custody preserved? Was the test done properly at the TBI crime lab? There are a host of issues in the chemical results of your blood test.
A DUI arrest is unlike any other criminal charge. It has issues of science. It has issues of field sobriety testing that are complex and technical. These need to be handled by someone that has expertise and training in that area. Your divorce lawyer can't handle it. A general lawyer can't handle it. And some criminal lawyers can't handle it.

Attorney Rob was the attorney I hired to defend me for a DUI arrest I experienced in 2007. It took place in a TN county that is notorious for refusing to plead down DUI's to lesser charges under any circumstances, and for insisting on nothing less than at least the minimum sentencing requirements for this offense. (Williamson) Upon the very first viewing of my "arrest tape" that we were finally allowed to see - along with the arresting officer, Rob was able to spot the officer giving me a bad command, starting me out on the wrong foot.
