Charges Of Prostitution

According to Tennessee Code Annotated 39-13-513, prostitution is:

"... engaging in, or offering to engage in sexual activity as a business or being an inmate in a house of prostitution or luring in a public place for the purpose of being hired to engage in sexual activity."

It is a Class B misdemeanor. However, if it is committed within 1.5 miles of a school, the penalties increase to at least seven days of jail time and at least $1,000 in fines.

Charges Of Patronizing A Prostitute

Patronizing prostitution means paying or offering to pay someone for sexual services, whether they are male or female. It is a Class B misdemeanor and carries up to six months of jail time and up to $500 in fines. As with prostitution charges, the penalties increase if the offense was committed within 1.5 miles of a school.

In Nashville, undercover agents often work sections of Dickerson Road, Murfreesboro Road and Gallatin Road, posing as prostitutes. They also frequently post fake ads online. Sometimes, however, undercover agents or other law enforcement officials overstep their bounds and engage in entrapment. Entrapment, or persuading an innocent person to commit a crime he or she did not intend to commit, is illegal and potential grounds to get the case dismissed.
