What is an Obstruction of Justice Charge ?

While listening to NPR coming back from General Sessions Court in Murfreesboro,  the talk wasw hether the President should be charged with an obstruction of justice charge. Under 18 U.S.C. section 1503, the government must prove three elements to obtain a conviction on an obstruction of justice charge.

  1. The government must prove there was a pending judicial proceeding.
  2. The defendant had knowledge or notice of the pending proceeding.
  3. The defendant acted corruptly with the specific intent to obstruct or impede the proceeding.

The U.S. Supreme Court has explained that corruptly means wrongful, immoral, depraved, or evil.
