Is DUI a criminal offense?

Under Tennessee law, any driving under the influence charge, currently referred to as a DUI, is a criminal offense. The difference is sometimes a DUI charge can be moved up to a felony. But a misdemeanor charge is a charge of which the range of punishment is less than one year. So a DUI first, a DUI second offense and a DUI third offense are all misdemeanors.

A felony DUI is a DUI in which they allege it is your fourth offense. We also have a aggravated DUI, is a class C felony which carries a range of punishment of three to 15 years.
