Types of Statutory Rape Charges in Tennessee
There are different types of statutory rape charges under Tennessee law, depending on the age of the alleged victim and the age of the defendant at the time of the alleged offense:
- Statutory rape, which involves unlawful sexual penetration between a victim who is between 13 and 15 years old and a defendant who is at least 4 years older. It can also apply when the act involves someone 15 to 18 years old and a defendant who is at least 5 years older.
- Mitigated statutory rape, which involves unlawful sexual penetration between a victim who is between 15 and 18 years old and a defendant who is 4 to 5 years older. Both statutory rape and mitigated statutory rape are Class E felonies that carry one to six years of prison time, plus fines.
- Aggravated statutory rape, which involves unlawful sexual penetration between a victim who is between 13 and 18 years old and a defendant who is at least 10 years older. This is a Class D felony and carries 2 to 12 years of prison time, plus fines.
