What is Domestic Violence?

A domestic violence charge is normally against a family member, a relative, a girlfriend, a wife, a husband, a former girlfriend, wife, or husband, and it normally carries that you've had some sort of relationship with that person.

Vandalism is not technically a domestic violence charge, but in Davidson County vandalism between family members will wind itself through the domestic violence courts.

Jail time depends on is it your first offense on the domestic violence. The other thing that you have to look at is whether it's a aggravated assault. So normally you go to court. Within seven to ten days they rest, and they try to set your first trial date within thirty days from that date, but I would think that most cases can be resolved within six months at worst.

A domestic violence charge can be dismissed. It depends on the facts and circumstances of the case. One of the big factors that the DAs, the police, the judges look at is who's the primary aggressor. They also look at the activity involved. So there's a whole area of ways the case can be dismissed.

The big consequence if you're convicted of a domestic violence charge is your loss of your second amendment privileges to own or possess a firearm. If you're convicted of a domestic violence, it can stay on your record permanently. However, there are solutions to avoid that.
